Terms of Service

1. The Service

Monkeynme is a marketing workspace: campaign planning, AI-assisted content and pictures, publishing to social networks and blogs, landing pages with lead capture, SEO with backlink monitoring, e-mail marketing to opt-in contacts and a sales CRM. Features differ by plan as described on our Pricing page.

2. Accounts

You must give accurate registration information and keep your sign-in details confidential. You are responsible for all activity in your organisation's account, including that of the team members you invite. Tell us at once at [email protected] if you suspect unauthorised use.

3. Subscriptions, billing and our reseller

• Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
• Paid plans (Starter and Growth) are billed in advance in euros (EUR), monthly or yearly as you choose at checkout. Agency plans are agreed and invoiced individually.
• Prices on the Pricing page exclude VAT and other sales taxes; Paddle adds the tax that applies to you at checkout. Businesses can enter a VAT number where reverse charge applies.
• There is no free trial. Every new subscription is covered by our 14-day money-back guarantee (see the Refund Policy).
• Subscriptions renew automatically for the same period until cancelled. You can cancel at any time in the app (Settings → Billing) or through Paddle's customer portal; the cancellation takes effect at the end of the current billing period and the Service stays available until then.
• Upgrades take effect immediately and the difference is charged pro rata. Downgrades take effect at the next renewal.
• If a payment fails, Paddle retries it for a period; if it cannot be collected, access to the paid features may be suspended until the payment is made.
• We may change prices with at least 30 days' notice by e-mail; a change applies from your next renewal after the notice period.

4. Your content and your responsibility

• You keep all rights to the content, contacts and data you put into the Service. You give us the rights we need to host, process and publish it on your instruction, only to provide the Service to you.
• You decide what is published or sent. Review AI-generated texts and pictures before publishing them: they can contain mistakes, and you are responsible for what goes out in your name.
• When you publish to social networks or send e-mails through your own accounts and mailboxes, you must follow the rules of those platforms and the laws that apply to you, including anti-spam, e-commerce and data-protection law. E-mail campaigns may only go to people who have agreed to receive them or are your existing customers where the law allows it, with a working unsubscribe link and correct sender information.
• For personal data of your contacts and leads that you process in the Service, you are the controller and we are your processor. A data processing agreement is available on request.

5. Acceptable use

You agree not to:

• send unsolicited e-mail or messages (spam), including cold outreach to people who have not agreed to hear from you, or use the Service for deceptive, fraudulent or illegal content;
• publish content that infringes the rights of others, including copyright, trademarks and personality rights;
• attempt to break, overload, scrape or reverse-engineer the Service, or get around plan limits or security measures;
• resell or give access to the Service to people outside your organisation, except agencies serving their own clients under their plan.

6. Third-party services

The Service connects to services you choose, such as Instagram, Facebook, LinkedIn, TikTok, YouTube, Google Search Console, Canva or your e-mail provider. Their own terms apply to your use of them, and we are not responsible for their availability or for changes they make to their interfaces.

7. Intellectual property

The Service, including its software, design and documentation, belongs to Zakomo FZCO. We grant you a non-exclusive, non-transferable right to use it for your organisation for as long as your subscription is active.

8. Availability and changes

We work to keep the Service available and secure but do not promise uninterrupted operation. We may improve and change features; we will not remove a core feature of your plan during a paid period without a fair alternative or a pro-rata refund.

9. Limitation of liability

To the extent permitted by law, our total liability arising out of or related to the Service is limited to the amounts you paid for the Service in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect or consequential damages, lost profits, lost data that you could have exported, or the actions of third-party platforms. Nothing in these Terms limits liability that cannot be limited by law.

10. Termination

You may close your account at any time. We may suspend or terminate accounts that seriously or repeatedly breach these Terms, with notice where practical. After the end of a subscription we keep your data for 30 days so you can reactivate or export it, and then delete it, unless the law requires us to keep it longer.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates. The courts of Dubai have jurisdiction, unless mandatory consumer-protection law of your country of residence gives you other rights.

12. Changes to these Terms

We may update these Terms. We will tell you about material changes by e-mail at least 14 days before they take effect. If you do not agree, you may cancel before the change applies.
